ShiftFit Terms and Conditions
Rules, responsibilities, and important wellness limitations for using ShiftFit.
1. Acceptance of terms
By accessing or using ShiftFit, you agree to these Terms. If you do not agree, do not use the app.
2. Eligibility and age requirement
ShiftFit is intended for adults age 18 and older. You must be legally able to agree to these Terms.
3. User accounts
You are responsible for accurate account information, protecting credentials, and activity under your account.
4. App purpose
ShiftFit is a general wellness and fitness tool designed to help users reflect on movement, hydration, breaks, recovery, and progress.
5. Not medical advice
ShiftFit does not provide medical advice, is not a medical device, and does not diagnose, treat, cure, prevent, or monitor medical conditions.
6. Emergency situations
Do not use ShiftFit for emergency communication or decisions. Contact 911 or your local emergency services during an emergency.
7. Fitness and physical activity risks
Physical activity involves risk. Consult a qualified healthcare professional before starting or changing a routine, especially if you have symptoms or health concerns.
8. User responsibility
You are responsible for deciding whether activity is appropriate. Stop and seek appropriate help for chest pain, severe shortness of breath, fainting, dizziness, or other concerning symptoms.
9. Apple Health integration
Apple Health access requires permission. You control permissions through device settings, and Apple’s terms and policies also apply.
10. Accuracy of health and activity information
Activity, calorie, step, recovery, and wellness information may be incomplete, delayed, estimated, or inaccurate and should not be used for medical or safety-critical decisions.
11. Acceptable use
You may not misuse ShiftFit, violate law, harass others, manipulate data, interfere with service, reverse engineer except where law permits, or infringe rights.
12. User content and notes
You retain rights in content you submit and grant us a limited license to process it to provide the app. Do not enter emergency information or complete medical records.
13. Gamification
Gamification supports motivation and entertainment. Progress systems may be corrected, reset, changed, or discontinued.
14. Coins, badges, points, and rewards
Coins, badges, points, scores, rewards, and other virtual items may be changed, removed, reset, or corrected.
15. No monetary value
Coins, rewards, badges, scores, and virtual items have no cash value and cannot be redeemed or transferred unless expressly stated.
16. Subscriptions and purchases
If offered, purchase, renewal, cancellation, and refund terms will be displayed before purchase and governed by applicable store rules.
17. Apple App Store terms
For Apple downloads, these Terms are between you and us, not Apple. Apple is not responsible for ShiftFit or support, subject to applicable App Store terms.
18. Intellectual property
ShiftFit, its branding, software, design, and non-user content belong to us or our licensors and are protected by law.
19. Third-party services
Third-party services have separate terms and practices. We are not responsible for services outside our control.
20. Availability and app changes
ShiftFit may be unavailable, contain errors, or change during beta testing. Features may be modified, suspended, or discontinued.
21. Disclaimers
ShiftFit is provided “as is” and “as available” to the extent permitted by law, without guarantees about accuracy, availability, results, or fitness for a particular purpose.
22. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, or harms from reliance on app estimates.
23. Indemnification
To the extent permitted by law, you agree to indemnify us against claims arising from unlawful use, your content, or violation of these Terms.
24. Termination
You may stop using ShiftFit at any time. We may suspend or terminate access for violations, risk, legal requirements, or discontinuation.
25. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules, except where mandatory local law applies.
26. Dispute resolution
Before filing a claim, contact us and attempt informal resolution for 30 days. Remaining disputes will be handled in an appropriate Pennsylvania court unless law requires otherwise.
27. Changes to the terms
We may update these Terms as ShiftFit changes. Continued use after changes take effect constitutes acceptance where permitted.
